3. What Legal Bases Do We Rely On to Process Your Information?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time.
  • Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:
    • Analyze how our Services are used so we can improve them to engage and retain users
    • Diagnose problems and/or prevent fraudulent activities
    • Understand how our users use our products and services so we can improve user experience
  • Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.
  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

If you are located in Canada, this section applies to you.

We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
  • For investigations and fraud detection and prevention
  • For business transactions provided certain conditions are met
  • If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
  • For identifying injured, ill, or deceased persons and communicating with next of kin
  • If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
  • If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
  • If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced
  • If the collection is solely for journalistic, artistic, or literary purposes
  • If the information is publicly available and is specified by the regulations
  • We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments

4. When and With Whom Do We Share Your Personal Information?

In Short: We may share information in specific situations described in this section and/or with the following categories of third parties.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

The categories of third parties we may share personal information with are as follows:

  • Cloud Computing Services
  • User Account Registration & Authentication Services
  • Email Delivery Services
  • Data Analytics Services
  • Performance Monitoring Tools

  • Other Users. When you share personal information (for example, by posting comments, contributions, or other content to the Services) or otherwise interact with public areas of the Services, such personal information may be viewed by all users and may be publicly made available outside the Services in perpetuity. Other users will be able to view descriptions of your activity, communicate with you within our Services, and view your profile.

5. How Do We Handle Your Social Logins?

In Short: If you choose to register or log in to our Services using a third-party sign-in provider, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third-party account details — Sign in with Apple or Google Sign-In. Where you choose to do this, we will receive certain profile information about you from your sign-in provider. The profile information we receive will typically include your name and email address. If you use Sign in with Apple and choose to hide your email address, we will receive a private relay email address generated by Apple instead of your personal email address.

We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party sign-in provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

6. Is Your Information Transferred Internationally?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" above), in the United States and other countries.

If you are a resident of the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law, including through the use of the European Commission's Standard Contractual Clauses (or equivalent safeguards) for transfers of personal information from the EEA, UK, and Switzerland to our service providers where required.

7. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

8. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

9. Do We Collect Information From Minors?

You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. If a decision that produces legal or similarly significant effects is made solely by automated means, we will inform you, explain the main factors, and offer a simple way to request human review. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account.
  • Contact us using the contact information provided.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

If you have questions or comments about your privacy rights, you may email us at hello@funfitland.com.

11. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

12. Do United States Residents Have Specific Privacy Rights?

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. More information is provided below.

If you are a resident of Washington or Nevada, please also review our Consumer Health Data Privacy Policy, which provides additional information about how we handle consumer health data.

If you are a California resident and would like to make such a request, please submit your request in writing to us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?"

13. Do Other Regions Have Specific Privacy Rights?

In Short: You may have additional rights based on the country you reside in.

Australia and New Zealand

We collect and process your personal information under the obligations and conditions set by Australia's Privacy Act 1988 and New Zealand's Privacy Act 2020 (Privacy Act).

This Privacy Notice satisfies the notice requirements defined in both Privacy Acts, in particular: what personal information we collect from you, from which sources, for which purposes, and other recipients of your personal information.

If you do not wish to provide the personal information necessary to fulfill their applicable purpose, it may affect our ability to provide our services, in particular:

  • offer you the products or services that you want
  • respond to or help with your requests
  • manage your account with us
  • confirm your identity and protect your account

At any time, you have the right to request access to or correction of your personal information. You can make such a request by contacting us by using the contact details provided in the section "HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?"

If you believe we are unlawfully processing your personal information, you have the right to submit a complaint about a breach of the Australian Privacy Principles to the Office of the Australian Information Commissioner and a breach of New Zealand's Privacy Principles to the Office of New Zealand Privacy Commissioner.

Republic of South Africa

At any time, you have the right to request access to or correction of your personal information. You can make such a request by contacting us by using the contact details provided in the section "HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?"

14. Multiplayer Features and Platform Data Use

To enable multiplayer functionality, our app collects and processes certain personal data. This includes your user ID, device and network information, gameplay activity, and data necessary for friend lists, matchmaking, and real-time communication features (such as voice chat if enabled). This data is used solely to facilitate multiplayer interactions and ensure a seamless user experience. The personal data mentioned above may be obtained via platform permissions granted by Meta Horizon (e.g., Friends, Invites, Rooms, Parties), and is processed solely to support the multiplayer features of our application. We do not sell or share your personal data with third parties for marketing purposes. All data processing is carried out in accordance with applicable data protection regulations and our commitment to user privacy. By using the multiplayer features, you acknowledge and consent to this data processing.

15. Subscriptions and Entitlement Data

If you subscribe to premium features in our application, we collect and process specific data to manage your access to subscription-based services. This data includes:

  • Meta User ID: Your unique user identifier on the Meta platform
  • Transaction ID: A unique ID for the purchase provided by Meta's payment system
  • Subscription Plan ID: The identifier of the subscription product you selected
  • Subscription Status: Current state of your subscription (active, canceled, expired)
  • Subscription Start Date and End Date: Used to determine service eligibility
  • Auto-Renewal Preference: Whether the subscription is set to renew automatically
  • Device Identifier: To associate subscription access across sessions and devices
  • Entitlement Validation Timestamps: When your subscription status was last verified

This data is collected solely for the following purposes:

  • To verify your entitlement to access premium content and features
  • To support account management and assist with billing-related inquiries
  • To maintain consistent access across your devices
  • To fulfill our contractual obligations with you as a subscriber

We do not collect or store full payment method details (e.g., credit card numbers). Payment processing is handled directly by Meta's platform.

We do not use subscription-related data for:

  • Behavioral advertising or user profiling
  • Sharing with third-party marketing or analytics providers
  • Any purposes unrelated to the delivery and support of subscription-based features

All processing of subscription-related data is performed in accordance with applicable data protection laws and platform guidelines. If you have any questions about how we use subscription data or wish to exercise your data rights, including deletion, please contact us at hello@funfitland.com.

If you link your mobile account to your headset account, we also use your subscription status information (originating from Meta or Apple, depending on where you subscribed) to display your current membership status in the mobile app. The mobile app does not sell subscriptions or process payments.

16. Custom Clause: Global Data Deletion Right (Clarification)

We understand that certain sections of this Privacy Policy may describe your privacy rights as subject to applicable local laws. However, we voluntarily extend the right to delete your personal data to all users, regardless of jurisdiction. You may request deletion of your personal data, including any account or information associated with our services, by contacting us at hello@funfitland.com. Once we verify your identity, we will process your request and delete your personal data within 30 days, unless we are legally required to retain certain information (for example, to comply with fraud prevention, tax, or legal obligations). This global deletion right applies to all users, including those accessing our services through Meta platforms.

For deletion of your mobile account specifically, see the "Account Deletion" clause below, which describes the in-app deletion path and what is and is not deleted.

17. Account Deletion

You can delete your FunFitLand account and its data at any time from Settings → Account → Delete Account in the app, or by contacting support@funfitland.com. Deletion is permanent and cannot be undone. Deleting your account does not cancel any subscription purchased through the App Store or the Meta Horizon Store. To stop billing, cancel it with Apple or Meta. Certain records may be retained where required by law. Health data stored in Apple Health or Health Connect is controlled by you within those apps. For step-by-step instructions, see https://www.funfitland.com/delete-account.

When you delete your mobile account, we permanently delete the personal information we store for that account on our servers — including your sign-in and profile information, information read from your linked headset account that we have stored, your heart rate and workout calorie records, and the link between your mobile account and your headset account. Deleting your mobile account does not delete your headset account or the data held under it on your headset platform; to request deletion of that data, contact us as described in the "Global Data Deletion Right" clause above, and we will process your request as described in this policy.

18. Mobile Account and Headset Account Linking

When you link your mobile account to the FunFitLand account on your headset, we read certain information from your headset account — your workout records, social activity, and membership status — in order to display it in the mobile app, and we store some of this information on our servers. Once linked, this information is associated with your mobile account.

We send a confirmation email whenever a link is created, so that you can detect a link you did not authorize. Linking cannot currently be removed from within the app; to change or remove a link, contact us using the details in the "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" section and provide the FFL Account code shown in the app. After a link is removed, the mobile app will no longer display information from that headset account; information already stored on our servers is handled in accordance with the section "HOW LONG DO WE KEEP YOUR INFORMATION?" and the "Account Deletion" clause above.

19. Health Data, Heart Rate, and Connected Devices

If you choose to connect a supported device — an Apple Watch, a Wear OS smartwatch, or a Bluetooth heart rate monitor — the app collects your real-time heart rate (BPM) during workout sessions. Heart rate readings are transmitted from the device to your phone and then to our servers. At the end of a workout session, we use these readings to calculate workout results, including calories burned. We store your workout heart rate and calorie data on our servers as part of your workout records.

With your permission, we also write your workout data (including heart rate and active calories) to Apple Health (via HealthKit) on iOS or to Health Connect on Android, so that your workouts appear in your system health records. We only write to these services: we do not read your historical health data from Apple Health or Health Connect, and we do not use them as a database for our Services. On Apple Watch, the watch app reads your real-time heart rate during an active workout session; this requires your explicit Health authorization, which you can revoke at any time in your device settings. Health data stored in Apple Health or Health Connect is controlled by you and can be managed or deleted within those apps.

We treat your health data with heightened care: we never use health or workout data (including heart rate and calories) for advertising, we never send it to analytics or crash reporting tools, and we never disclose it to third parties for marketing, advertising, or data-mining purposes.

We keep your heart rate and workout data for as long as you have an account, so that your workout history stays available to you. If you delete your account, or ask us to delete your heart rate data, we will delete it. Health data is otherwise retained and deleted in accordance with the section "HOW LONG DO WE KEEP YOUR INFORMATION?" and the "Account Deletion" clause above.

If you are a resident of Washington or Nevada, please also review our Consumer Health Data Privacy Policy.

20. Analytics, Crash Reporting, and Push Notification Services

We use Firebase, a service provided by Google LLC, for app analytics (Firebase Analytics), crash reporting (Firebase Crashlytics), and push notification delivery (Firebase Cloud Messaging). These services process a limited set of information on our behalf under data processing terms: general app usage and interaction events, device information (such as device model, operating system version, and push notification tokens), diagnostic and crash data, and an approximate region derived from your IP address.

We configure these services narrowly: we never send health, heart rate, calorie, or workout data to analytics or crash reporting tools; we do not collect advertising identifiers (such as IDFA or GAID); and we do not track you across apps or websites owned by other companies. Because we do not track, the app does not request App Tracking Transparency permission on iOS.

Push notifications are used for workout reminders and important notices about your account. You can turn off push notifications at any time in your device settings or in the app's settings.

21. Do We Make Updates to This Notice?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

If we make material changes to this Privacy Notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Notice frequently to be informed of how we are protecting your information.
